12. Arbitration and Class Action Waiver

You and Sarah Elise agree that any dispute, claim, or controversy arising out of or relating to your purchase, these Terms, our policies, or your relationship with Sarah Elise shall be resolved by binding arbitration, except that either party may bring an eligible individual claim in small claims court.

The arbitrator may not consolidate claims or preside over any class or representative proceeding.

By agreeing to arbitration, both you and Sarah Elise waive the right to a trial by judge or jury, except where small claims court applies.

These Terms are governed by the laws of the State of New York, without regard to conflict of laws principles.

To the extent a dispute is not subject to arbitration, it shall be brought exclusively in the state or federal courts located in New York County, New York, and you consent to jurisdiction there.

14. Intellectual Property

All website content, including text, images, graphics, product names, logos, and designs, is owned by or licensed to Sarah Elise and may not be used without prior written permission.
